FINDINGS OF FACT AND CONCLUSIONS OF LAW
After careful consideration of the entire record, the undersigned makes the following findings:
1. The claimant's date last insured is December 31, 2010.
2. The claimant has not engaged in substantial gainful activity since January 2, 2006, the alleged onset date (20 CFR 404.1520(b), 404.1571 et seq., 416.920(b) and 416.971 et seq.).
The claimant worked after the established disability onset date, but this work activity did not rise to the level of substantial gainful activity.
3. The claimant has the following severe impairments: rheumatoid arthritis, headaches, and depression (20 CFR 404.1520(c) and 416.920(c)).
The claimant has the following degree of limitation in the broad areas of functioning set out in the disability regulations for evaluating mental disorders and in the mental disorders listings in 20 CFR, Part 404, Subpart P, Appendix 1: mild restriction in activities of daily living, mild difficulties in maintaining social functioning, moderate difficulties in maintaining concentration, persistence or pace, and no episodes of decompensation, each of extended duration.
At a May 2008 consultative psychological evaluation, the claimant reported that her mother had been murdered when she was 11 years old and that she had been molested by her stepfather. She denied a history of psychotherapy but had been prescribed psychotropic medications in the past. She reported feelings of sadness, hopelessness, anhedonia, irritability, anxiety, frustration, and stress. Shereported that she was able to take care of her personal hygiene without assistance, shopped for herself, and managed her money without assistance. She did not drive or do housecleaning. She spent her day reading her Bible, drinking coffee, trying to clean, and watching television. She did not engage in recreational activities due to pain but enjoyed being around her grandchildren. The claimant was cooperative and attentive. Her mood was labile, vacillating from tearfulness to happiness. Initially she seemed irritable and guarded. Her thought processes were irrational at times, and her activity level was agitated and restless. Her remote and immediate memory was good, however, she was unable to perform serial 7's, suggesting some difficulties in attention and concentration. The claimant was diagnosed with major depressive disorder, single, with psychotic features and post traumatic stress disorder, chronic. The undersigned finds that the results of the consultative evaluation indicate that the claimant has moderate limitations in her ability to concentrate due to pain and symptoms associated with depression and is therefore limited to performing simple, repetitive tasks.
4. The claimant does not have an impairment or combination of impairments that meets or medically equals one of the listed impairments in 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 404.1520(d) and 416.920(d)).
5. The claimant has the residual functional capacity to perform sedentary work as defined in 20 CFR 404.1567(a) and 416.967(a) except she can lift and carry less than 10 pounds frequently or occasionally, can sit for less than 6 hours in an 8 hour workday, can stand/walk for less than 2 hours in an 8 hour workday, and is limited to performing simple, repetitive tasks.
