FINDINGS OF FACT AND CONCLUSIONS OF LAW
After careful consideration of the entire record, the undersigned makes the following findings:
1. The claimant's date last insured is June 30, 2008.
2. The claimant has not engaged in substantial gainful activity since June 1, 2004, the alleged onset date (20 CFR 404.1520(b). 404.1571 et seq; 416.920(b) and 416.971 et seq.).
3. The claimant has the following severe impairment(s): mental retardation (20 CFR 404. 1520(c) and 416.920(c)).
4. The severity of the claimant's impairment meets the criteria of section 12.05 of 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 404.1520(d) and 416.920(d)).
In making this finding, the undersigned considered all symptoms and the extent to which these symptoms can reasonably be accepted as consistent with the objective medical evidence and other evidence, based on the requirements of 20 CFR 404.1529 and 416.929 and SSRs 96-4p and 96-7p. The undersigned has also considered opinion evidence in accordance with the requirements of 20 CFR 404.1527 and 416.927 and SSRs 96-2p, 96-6p and 06-3p.
The claimant's impairment meets listing 12.05B. The "paragraph B" criteria of this listing are met because the claimant has mental retardation initially manifested before age 22 with a valid verbal, performance, or full scale IQ of 59 or less.
Consultative psychologist, Sheryl Ferguson, Psy.D., conducted IQ testing resulting in the claimant obtaining a Full scale IQ of 55 (Exhibit 24F).
As such, testifying medical expert, Dr. Benovitz opined that the claimant's mental impairment meets listing 12.05(B) from his alleged onset date.
There is a reasonable presumption that "mental retardation is a condition that remains constant throughout life." A claimant need not present evidence that he or she manifested deficits in adaptive functioning prior to age 22, when he or she presented evidence of IQ test results (or, for that matter, other appropriate evidence of such mental deficits) that met the severity level recited in § 12.05 of the Listings of Impairments after the age of 22. Hodges v. Barnhart, 276 F.3d 1265, 1266 (11th Cir. 2001).
After considering the evidence of record, the undersigned finds that the claimant's medically determinable impairment could reasonably be expected to produce the alleged symptoms, and that the claimant's statements concerning the intensity, persistence and limiting effects of these symptoms are generally credible.
The State agency psychological consultants' mental assessments are given little weight because other medical opinions are more consistent with the record as a whole.
5. The claimant has been under a disability as defined in the Social Security Act since June 1, 2004, the alleged onset date of disability (20 CFR 404.1520(d) and 416.920(d)).
DECISION
Based on the application for a period of disability and disability insurance benefits filed on February 28, 2007, the claimant has been disabled under sections 216(i) and 223(d) of the Social Security Act since June 1, 2004.
Based on the application for supplemental security income filed on February 28, 2007, the claimant has been disabled under section 1614(a)(3)(A) of the Social Security Act since June 1, 2004.
The component of the Social Security Administration responsible for authorizing supplemental security income will advise the claimant regarding the non disability requirements for these payments, and if eligible, the amount and the months for which payment will be made.
A determination to appoint a representative payee to manage payments in the claimant's interest is recommended.
