Employment discrimination occurs when an employer makes biased decisions regarding the hiring, firing, compensation, and promotion of an employee based on his or her gender, race, or other protected attributes. In the United States, employment discrimination is against the law
Title VII of the Civil Rights Act of 1964 is one of many laws prohibiting employment discrimination. This law makes it illegal for businesses with 15 or more employees to discriminate based on gender, national origin, race, or religion.
Title VII also prohibits employers from developing tests that would screen out one group of applicants unless there is a proven reason for the test. However, if the job requires employees to move heavy objects, such as package delivery, the test is necessary and therefore non-discriminatory.

Racial Discrimination
While the United States has come a long way since the Civil Rights movement, race discrimination still occurs in the workplace. According to a 2002 Rutgers University Study, 46% of African American employees feel that they have been treated unjustly because of their race.
The study also states that 28% of African Americans and 22% of Hispanics have been discriminated against in the workplace, while only 6% of Caucasians have experienced workplace discrimination.
Racial discrimination can take many forms, from an employer not hiring an individual to passing an employee over for a promotion on the basis of skin color.
