FINDINGS OF FACT AND CONCLUSIONS OF LAW
After careful consideration of the entire record, the undersigned makes the following findings:
1. The claimant has not engaged in substantial gainful activity since June 30, 2007, the amended alleged onset date (20 CFR 416.920(b) and 416.971 et seq.).
2. The claimant has the following severe impairments: cardiovascular disease, status-post myocardial infraction, amnesic disorder, borderline personality cognitive disorder, fibromyalgia, and chronic low back and neck pain. (20 CFR 416.920(c)).
The claimant has the following degree of limitation in the broad areas of functioning set out in the disability regulations for evaluating mental disorders and in the mental disorders listings in 20 CFR, Part 404, Subpart P, Appendix 1: moderate restriction in activities of daily living, mild difficulties in maintaining social functioning, marked difficulties in maintaining concentration, persistence or pace.
3. The claimant does not have an impairment or combination of impairments that meets or medically equals one of the listed impairments in 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 416.920(d)).
4. The claimant has the residual functional capacity to perform light work as defined in 20 CFR 416.967(b) except the claimant has to avoid concentrated exposure of dust, odors, fumes, poor ventilation and other pulmonary irritants. Additionally, due to memory problems, the claimant can occasionally understand, remember and carry out short and simple instructions and requires frequent supervision.
In making this finding, the undersigned considered all symptoms and the extent to which these symptoms can reasonably be accepted as consistent with the objective medical evidence and other evidence, based on the requirements of 20 CFR 416.929 and SSRs 96-4p and 96-7p. The undersigned has also considered opinion evidence in accordance with the requirements of 20 CFR 416.927 and SSRs 96-2p, 96-6p and 06-3p.
On July 30, 2005, the claimant was admitted to JFK Medical Center with chest pain and was diagnosed with severe coronary artery disease and severely reduced left ventricular systolic function (Exhibit 1F). The claimant's cardiologist, Dr. Shaul S. Dadi, describes a history of: myocardial infraction with a stent to the left anterior descending Artery, cardiogenic shock, memory loss and difficulty with speech (Exhibit 7F). Dr. Dadi asserts the claimant's condition is permanent and renders her unable to work (Exhibit 13F). The undersigned accords great weight to Dr. Dedi's opinion. As a treating source, he has had the opportunity to personally evaluate and oversee treatment of the claimant. He has provided a detailed picture of the claimant's impairments and his opinion is consistent with the substantial evidence of record (Social Security Ruling 96-2p).
