FINDINGS OF FACT AND CONCLUSIONS OF LAW
After careful consideration of the entire record, the undersigned makes the following findings:
1. The claimant was bom on December 3, 2005. Therefore, she was an older infant on September 20, 2006, the application date, and is currently a preschooler (20 CFR 416.926a(g)(2)).
2. The claimant has not engaged in substantial gainful activity since December 3, 2005, the alleged onset date (20 CFR 416.924(b) and 416.972).
3. The claimant has the following severe impairment: a complete dislocation with proximal migration of the left hip and left leg discrepency (20 CFR 416.924(c)).
The above impairment causes more than minimal functional limitations.
4. The claimant does not have an impairment or combination of impairments that meets or medically equals one of the listed impairments in 20 CFR Part 404, Subpart P, Appendix 1 (20 CFR 416.924,416.925 and 416.926).
5. The claimant has an impainnent or combination of impairments that functionally equals the listings (20 CFR 416.924(d) and 416.926a).
In determining the degree of limitation in each of the six functional domains, the undersigned has considered all symptoms in accordance with the requirements of 20 CFR 416.929 and SSR 967p. The undersigned has also considered the opinion evidence, consistent with 20 CFR 416.927 and SSRs 96-2p, 96-5p, 96-6p and 06-3p.
The claimant's impairment causes:
• no limitation in acquiring and using information
• no limitation in attending and completing tasks
• no limitation in interacting and relating to others
• no limitation in moving about and manipulating objects
• no limitation in caring for personal needs
• an extreme limitation in health and physical well-being
The claimant's grandmother, Stephanie Harris, testified that she is in the process of adopting her granddaughter. Ms. Harris noted that the claimant's leg hurts when she stands or runs, that she cannot sit without pain, and that one leg and foot is bigger than the other. Ms. Harris stated that the claimant's mother did not want the claimant to have any operation. However, Ms. Harris noted that when the adoption is final, the claimant will have the recommended surgery and most likely many additional surgeries throughout her life.
