The insured party hires an indemnity company by paying periodic (usually monthly) premiums. By agreeing to the insurance policy terms with your signature and monies, you are honoring your part of the contract. When a situation covered by your policy occurs, you can make an insurance claim and receive whatever compensation your policy states.

In dealing with your insurance claim, the company must:

• act in a timely manner,
• cooperate with you, and
• satisfy your inquiries.

In investigating the circumstances of your case, it must search allowable parameters for reasons to confirm your claim, not deny it. The insurer's business model and offer to you is to cover your losses, not to do so only when it finds exception to a policy of not covering them.

If it does deny your request for reimbursement or damages compensation, you are due a written explanation that corresponds to terms in your policy. The policy, in addition, must exhibit a reasonable explanation of coverage, not misleading language that exempts the company from its duty.

When a Company Acts in Bad Faith

Bad faith on the part of the insurer is not retaliation for breach of contract by the insured - it is intentional unfair dealing to get out of paying legitimate obligations. In other words, if you fail to make your premium payments, service can be denied you by the company. But if you make your payments and follow any other conditions of service, and the company still denies or delays claims that should be covered, it breaches the contract AND operates in "bad faith." Each of these infractions is covered by a different area of law, contract and tort.

Bad faith can include denial, delay in paying, underpayment, unreasonable interpretation of and failure to adequately investigate a covered insurance claim.
