Ms. Mayo is a 48 year-old woman with an eighth grade education whose primary occupation has been as a waitress, owever, she has not held any regular employment since 1999. When examined by State medical examiners, she reported several somatic conditions, including Hepatitis C, Diabetes Mellitus, high blood pressure, lower back pain, dizziness, and exhaustion. She stated she was taking the prescription medications Zovarax, Cipro, HCTZ, Glucophage, Reglan, ydrocodone, Novolin, Cymbalta, and Risperdal. Claimant reported she has been hospitalized three times for attempted suicide.

Claimant told one of the State's psychological consultative examiners, Dr. Alele Besner, Psy.D., that in November of 2007 she was living with a friend of hers in a home that was infested with rats. Claimant told the examiner she thought rats were in claimant's bowel movements. Additionally, claimant testified before the undersigned that her boyfriend was shot and killed by police officers; and the police officers told her that if she testified against them, they would kill her. Consequently she always has to be looking over her shoulder. The undersigned notes that there are no reports of claimant receiving any type of psychological counseling in this application for disability.

Medical evidence of record shows claimant has been treated for cellulitis in her right elbow in 2005 and a bladder infection in 2007. Claimant was admitted to the hospital in October of 2008 for emergency treatment of uncontrolled diabetes mellitus. At that time she was also treated for dysuria and left knee pain.

Physical and mental examinations performed at the request of the State are the only other evidence provided or obtained that documents claimant's other health issues. Dr. John J. Catano, M.D., conducted a physical examination of claimant in March of 2008. He determined claimant had chronic hepatitis C+ without telangiectasias, icterus, ascites or lower extremities edema. He also found her to have chronic fatigue syndrome, lower back musculoskeletal pain, and polyarthralgias. The undersigned found this report credible and gave it moderate weight.

Dr. Adele Besner, Psy.D., performed a psychological evaluation of claimant at the request of the State in March of 2008. She reported claimant's mood was depressed and her recent memory was poor. Ms. Mayo's overall performance on the Memory Scale was indicative of someone who has some limitations in her cognitive functioning, and/or is confronted by an organic condition. The results of testing her auditory and visual memory showed she was operating in the low-average and borderline ranges. Dr. Besner diagnosed claimant as having a congnitive disorder, NOS, and an adjustment disorder with depressed mood. She determined claimant's psychological prognosis to be guarded because claimant was not receiving psychological or psychiatric services at that time. The undersigned consideredthis opinion and found it to have a solid basis for determining claimant to have a mental problem that significantly contributes to claimant being disabled.
