Sultan Ahmed M.D. performed a consultative examination on April 9, 2007, and reported that the claimant complained of left leg weakness, difficulties lifting with his left shoulder, and weakness of his left hand grip. Dr. Ahmed noted that the claimant had difficulty lifting his left forearm above his head due to left shoulder restricted range of motion. Dr. Ahmed indicated that the claimant demonstrated an abnormal unsteady gait. Dr. Ahmed diagnosed the claimant with left hand grip weakness, left leg weakness, abnormal gait, history of cerebrovascular accident, HIV, hepatitis C, left shoulder restricted range of motion, and history of polysubstance abuse (Exhibit 5F, pages 1-3).

Kimberly Holding, M.D. evaluated the claimant on April 18, 2007, for complaints of HIV infection. Dr. Holding noted that the claimant had oral thrush and thoracic spine pain. Dr. Holding diagnosed the claimant with HIV infection with a CD4 count of 179, a viral load of 15,000, hepatitis C, and arthritis. On June 3, 2008, Dr. Holding reported that the claimant had a CD4 count of 135 and a viral load of 58,000. On June 25, 2008, Dr. Holding reported that the claimant had a CD4 count of 150 and a viral load of 100,000 (Exhibit 10F, pages 4-6 and 12-13).

The claimant testified at the hearing that he had a stroke in 2004 and currently has residual from that stroke. The claimant stated that for a period of time, he was in a wheelchair and now experiences pain from his head down to his chest, he has weakness and he cannot exert himself. The claimant related that the stroke affected his left leg as well and has problems with standing and walking. The claimant testified that his HIV infection causes weakness, fatigue, lack of energy, insomnia, night sweats, and weight loss. The claimant stated that he has hepatitis C which causes fatigue and related that he has pain everywhere. The claimant testified to past drug abuse, but stated he is currently clean and had not used drugs since 2004. The claimant testified that he has a bad temper and is forgetful.

The claimant's representative, Adam Neidenberg, stated that the claimant met Listing 14.08 as the claimant's CD4 count was in the range of 120 to 150 over the last two years.

After considering the evidence of record, the undersigned finds that the claimant's medically determinable impairment(s) could reasonably be expected to producethe alleged symptoms, and that the claimant's statements concerning the intensity, persistence and limiting effects of these symptoms are generally credible.
