The claimant testified that she experiences back, shoulder, and neck pain that prevent her from standing or sitting for long. Her legs are weak, and her balance is off. The claimant stated that she has difficulty turning her neck to the right and has headaches as a result of her neck pain. Her headaches occur 3 to 4 times a week and may lastup to 12 hours. Her pain also radiates down her legs, which go numb. The claimant needs help getting up after stooping or kneeling, and she cannot crawl. She takes her medications four times per day. The claimant stated that her medications upset her stomach and cause her to feel drowsy. She lies in bed with her knees up and puts a warm compress on her stomach.The claimant estimated that she can lift 10 pounds, is able to stand for 30 to 45 minutes at a time, and can sit for 30 minutes at a time. A 2006 motor vehicle accident worsened her condition, and she treated with a chiropractor. Before the accident,the claimant was able to do household chores, however, she is now limited in her ability to perform chores. During the day, the claimant visits her daughter and grandchild. She must take a pain pill before she attends church once or twice a week.

After considering the evidence of record, the undersigned finds that the claimant's medically determinable impairments could reasonably be expected to produce the alleged symptoms; however, the claimant's statements concerning the intensity, persistence and limiting effects of these symptoms are not credible prior to October 22, 2007, to the extent they are inconsistent with the residual functional capacity assessment for the reasons explained below.

In terms of the claimant's alleged neck and back pain, an MRI of the cervical spine conducted in December 2006 revealed straightening that was suggestive of underlying muscular spasm, disc bulging at C5-6 and C6-7, and neural encroachment at C6-7 and C7-T1, while MRl of the lumbar spine revealed disc bulging at L3-4 and 14-5, posterior disc herniation at L5-S1, and neural encroachment from L3-4 through L5-S1 (Ex. 9F). She underwent chiropractic treatment that included cervical, thoracic, and lumbar manipulation, traction, and the application of moist heat and electrical stimulation (Ex. 10F). The claimant was evaluated by Dr. Jeffrey Kugler, an orthopedist, in January 2007, at which time examination revealed tenderness to palpation about the neck with decreased range of motion, 4/5 motor strength, intact sensation, and 1+ reflexes, along with significant paravertebral spasm. She also had marked tenderness to palpation of the lumbar spine with decreased range of motion, positive straight leg raise, 4/5 motor strength, and intact sensation with paravertebral spasm about the lower thoracic and lumbosacral spine. She walked with a significant antalgic gait with decreased stance phase.
