A psychological evaluation and memory testing on April 16, 2007 indicated that the claimant had serious limitations in her intellectual functioning and/or is confronted by an organic condition. She did not appear able to perform any of the activities that may be required by a workplace and was diagnosed with cognitive disorder, NOS, and major depressive disorder, recurrent moderate. On March 18, 2008 a psychological examination noted that the claimant was currently homeless and had a history ofseizures due to a 1994 head injury, as well as HIV since 1994, and hepatitis C. She had a history of cocaine use but was drug free for one year. She presented as disheveled and was not oriented to time. She evidenced poor memory functions and poor attention and concentration. She appeared to be of borderline intelligence and had poor insight, social judgment and impulse control.

At the hearing the claimant testified that she continues to have seizures and has no insurance or money to buy medications. She stated that she was on crack cocaine but has been off it for at least two years. She lives with her mother, who testified that she has witnessed the claimant's seizures. After considering the evidence of record, the undersigned finds that the claimant's medically determinable impairments could reasonably be expected to produce the alleged symptoms and that the claimant's statements concerning the intensity, persistence and limiting effects of these symptoms are generally credible.

The State agency medical consultants' physical assessments and psychological consultants' mental assessments are given little weight because other medical opinions are more consistent with the record as a whole and evidence received at the hearing level shows that the claimant is more limited than determined by the State agency consultants. Furthermore, the State agency consultants did not adequately consider the claimant's subjective complaints or the combined effect ofthe claimant's impairments. The undersigned accords significant weight to the opinions of the claimant's treating physicians and to the consultative psychological examiner.

The Administrative Law Judge finds that based on the medical evidence of record and testimony, the claimant has a seizure disorder occurring more frequently than once a month in spite of at least 3 months off prescribed treatment and with daytime episodes (loss of consciousness and convulsive seizures). Her impairment meets the requirements of listing 11.02.

4. The claimant has been under a disability as defined in the Social Security Act since August 15,2007, the date the application was filed (20 CFR 416.920(d)).

5. The claimant's substance use disorder is not a contributing factor material to the determination of disability (20 CFR 416.935).

Medical records show that the claimant had a history of substance use (cocaine), which was not current and there is no documented evidence ofan ongoing substance use disorder.

DECISION

The claimant has been disabled undersection 1614(a)(3)(A) of the Social Security Act since August 15,2007, the date the application for supplemental security income was filed.

The component of the Social Security Administration responsible for authorizing supplemental securityincome will advisethe claimant regarding the nondisability requirements for these payments, and if eligible, the amount andthe months for which paymentwill be made.
