I find that the claimant's fatigue and symptoms associated with HIV, along with the disc herniation that she suffered after her 2003 motor vehicle accident, substantially compromise her ability to function. In addition, the claimant's peripheral neuropathy, which may be either the result of AIDS or due to her spinal injury, impacts her ability to stand, walk, and use her hands for fine and gross manipulation. Furthermore, the claimant was diagnosed with Major Depressive Disorder, recurrent, severe, with psychotic features, at a July 2008 consultative psychological evaluation (Ex. 11F). While the claimant's IQ scores, including her Full Scale IQ score of 67, were in the extremely low range, there is no evidence of a prior diagnosis of borderline intellectual functioning, and her performance could well be related to her diagnosis of a Major Depressive Disorder.

After considering the evidence of record, I find that the claimant's medically determinable impairments could reasonably be expected to produce the alleged symptoms, and that the claimant's statements concerningthe intensity, persistence and limiting effects of these symptoms are generally credible.

The State Agency medical consultants' physical assessments and psychological consultants' mental assessments are given little weight because another medical opinion is more consistent with the record as a whole. Furthermore, the State Agency consultants did not adequately consider the claimant's subjective complaints. As noted above, Dr. Schosheim's opinion is given greater weight than those of the State Agency medical consultants. I further observe that Dr. Gary Cater, who specializes in neonatal-perinatal medicine, and Dr. David Guttman,who specializes in pediatric medicine, are the State Agency physicians who found that the claimant was capable of performing either a full range of medium work or a reduced range of light work (Ex. 6F, 8F). Given the fact that neither of these physicians specialize in infectious diseases, neurology, or orthopedics, I do not find them to be experts in these medical matters, and their opinions are not given any significant weight (Ex. 10F).

5. The claimant has been under a disability as defined in the Social Security Act since May 9, 2004, the alleged onset date of disability (20 CFR §404.1520(d) and §416.920(d)).

DECISION

Based on the application for a period of disability and disability insurance benefits filed on March §14, 2006, the claimant has been disabled under sections 216(i) and 223(d)of the Social Security Act since May 9, 2004.

Based on the application for supplemental security income protectively filed on April 6, 2007, the claimant has been disabled under §1614(a)(3)(A) of the Social Security Act since May 9, 2004.

The component of the Social Security Administration responsible for authorizing supplemental security income will advise the claimant regarding the nondisability requirements for these payments, and if eligible, the amount and the months for which payment will be made.

A determination to appoint a representative payee to manage payments in the claimant's interest is recommended.
