3. Marked difficulties in maintaining concentration, persistence, or pace; or
4. Repeated episodes of decompensation, each of extended duration ....

Consistent with the evidence of record, I find that the claimant's bipolar disorder is characterized by the symptoms set forth in A1a, A1c, A1e, A1g, A1i, A2e, A2f, A2g, and A2h of listing 12.04. I also find that the claimant has marked degrees of limitation in her activities of daily living. Her social functioning, and her abilities to maintain concentration, persistence, and pace. Thus, I find that the claimant's bipolar disorder meets the criteria of listing 12.04.

4. The claimant has been under a disability as defined in the Social Security Act since September 20, 2006, the alleged onset date of disability (20 CFR 416.920(d)).

5. The claimant's substance use disorders are not a contributing factor material to the determination of disability (20 CFR 416.935).

Dr. Ferrell testified that the claimant's substance abuse issues have been the result of her mental impairments, and not the other way around, and that they have specifically been an ineffective attempt at self-medicating the pain from her mental impairments. Dr. Ferrell opined that if the claimant were to stop taking illegal drugs and alcohol, she would still meet listed impairment 12.04 because none of her substance abuse has caused her specific emotional/mental pathologies.

I agree with Dr. Ferrell's opinion and find accordingly. Therefore, the claimant's substance abuse is not a contributing factor material to a determination of disability.

DECISION

Based on the application for supplemental security income protectively filed on September 20, 2006, the claimant has been disabled under section 1614(a)(3)(A) of the Social Security Act since September 20, 2006.

The component of the Social Security Administration responsible for authorizing supplemental security income will advise the claimant regarding the nondisability requirements for these payments,and if eligible,the amountand the months for which payment will be made.

A determination to appoint a representative payee to manage payments in the claimant's interest is recommended.
