Following my own careful review of the medical evidence, I agree with Dr. Schosheim's expert opinion and find that it is supported. The claimant was involved in a motor vehicle accident on November 3, 2004, causing the claimant to have neck pain with radiation to the right shoulder and low back pain radiating down the bilateral gluteal area and both posterior thighs. In February 2006, the claimant underwent a lumbar laminectomy and microdiskectomy. A post operative MRI dated November 16, 2007, showed the L5 vertebrae partially sacralized; straightening of the lumbar spine and partial L3 and L4 laminectomy defects. There is also a right paracentral and foraminal extradural defect at L4-5 which abuts the L4 nerve root in the neural foramina and compresses the L5 nerve root in the lateral recess, as well as posterior crowding of the nerve roots in the cauda equine from L3-L5 (Exhibit 16F/1 and 17F/6).

The undersigned also notes that the claimant was awarded a $200,000 settlement from a lawsuit he filed based on the accident.

After considering the evidence of record and hearing the testimony, the undersigned finds that the claimant's medically determinable impairments could reasonably be expected to produce the alleged symptoms, and that the claimant's statements concerning the intensity, persistence and limiting effects of these symptoms are generally credible.

The State agency medical consultants' physical assessments are given little weight because other medical opinions are more consistent with the record as a whole and evidence received at the hearing level shows that the claimant is more limited than determined by the State agency consultants.

4. The claimant has been under a disability as defined in the Social Security Act since November 14, 2005, the date the application was filed (20 CFR 416.920(d)).

DECISION

The claimant has been disabled under section 1614(a)(3)(A) of the Social Security Act since November 14, 2005, the date the application for supplemental security income was filed.

The component of the Social Security Administration responsible for authorizing supplemental security income will advise the claimant regarding the nondisability requirements for these payments, and if eligible, the amount and the months for which payment will be made.
