In making this finding, the undersigned considered all symptoms and the extent to which these symptoms can reasonably be accepted as consistent with the objective medical evidence and other evidence, based on the requirements of 20 CPR 404.1529 and 416.929 and SSRs 96-4p and 96-7p. The undersigned has also considered opinion evidence in accordance with the requirements of 20 CPR 404.1527 and 416.927 and SSRs 96-2p, 96-6p and 06-3p.

Progress notes from the claimant's primary care physician indicate that she carried diagnoses of disc herniation, rheumatoid arthritis that was uncontrolled, hypertension, and migraine headaches. As of May 2008, her diagnoses included inflammatory polyarthropathy, chronic rhinitis, esophageal reflux, mastodynia, and tobacco use disorder. MRI of the lumbar spine showed no acute abnormality, however, there were multilevel degenerative changes, including a right foraminal disc protrusion at L4-5 and mild disc desiccation and associated disc bulge. The claimant was seen in the emergency department for exacerbation of her rheumatoid arthritis. She had stopped taking medication and was told to restart treatment. The Administrative Law Judge finds that the medical evidence as a whole substantiates the claimant's testimony that her medical conditions, including rheumatoid arthritis and degenerative disc disease, impose significant limitations on her ability to perform the requirements of even less than sedentary activity in that she is substantially limited in her ability to lift and carry, sit, stand, walk, and perform postural and manipulative activities because of her pain and functional restrictions.

After considering the evidence of record, the undersigned finds that the claimant's medically determinable impairments could reasonably be expected to produce the alleged symptoms, and that the claimant's statements concerning the intensity, persistence and limiting effects of these symptoms are generally credible. The claimant testified that she has rheumatoid arthritis in all of her joints. She stated that she is in pain all the time and feels burning in her knees, legs, hips, and shoulders. She stated that she cannot make a fist, open a jar, or lift a glass. She gets shots and ahs used rubs, patches, and oral medications.

The State agency medical consultants' physical assessments and psychological consultants' mental assessments are given little weight because the State agency consultants did not adequately consider the claimant's subjective complaints or the combined effect of the claimant's impairments. According to a May 2008 consultative examination, there was no evidence of joint deformity, swelling, or tenderness, except for tenderness on lumbosacral flexion. The claimant's manual dexterity was normal, as was his gait. The impression was degenerative joint disease and depression. The undersigned finds that the treating physician progress notes correspond with the claimant's testimony regarding her significant limitations, which are given substantial weight.

6. The claimant is unable to perform any past relevant work (20 CFR 404.1565 and 416.965).
